The Challenge
"We registered for VAT last year but haven't made a single sale this quarter — the business has been quiet. Do I still need to file anything with the FTA, or can I just skip it since there's nothing to report?"
This is one of the most common misunderstandings we see among VAT-registered businesses in the UAE, especially newly licensed companies, dormant entities, or seasonal traders. Business owners assume that no transactions means no filing obligation. That assumption is wrong, and it can be an expensive one. VAT registration itself creates a standing legal obligation to file every return period, regardless of whether any taxable supplies or purchases occurred.
Our Approach
- The obligation is tied to registration, not activity — once a Tax Registration Number (TRN) is active, a VAT return is due for every tax period until the business formally deregisters, even if all boxes are zero.
- A nil return is filed the same way as a normal return — log into EmaraTax, open the relevant VAT return form, enter zero in the sales, purchases and VAT due fields, declare that no transactions took place, and submit before the standard filing deadline (typically the 28th of the month following the tax period end).
- Missing the deadline triggers the same penalties as a normal late return — the FTA does not waive late-filing fines just because the return was nil, so the deadline discipline matters even when there is nothing to declare.
We treat nil returns with the same process rigour as active filings for our clients. Before each deadline we confirm with the business whether any sales, purchases, imports or expenses occurred in the period, reconcile against bank activity to be certain nothing was missed, and then file confirming zero activity, so the compliance record stays clean and the TRN remains in good standing.
The Result
Businesses that treat every VAT period as a filing obligation, active or not, stay penalty-free and keep their EmaraTax compliance history clean, which matters for future audits, bank dealings and licence renewals. If a business expects to stay dormant or below the mandatory VAT threshold for the foreseeable future, deregistration should be considered separately, since that is the only way to formally end the filing obligation rather than continuing to file nil returns indefinitely.
The Takeaway
"A VAT registration obliges you to file every period, even with zero activity, so log into EmaraTax and submit a nil return by the normal deadline rather than skipping it."
