# The Challenge
"I set up my company in 2024 and started serving a client based outside the UAE. I assumed that because my customer was overseas, VAT simply did not apply to me. Nobody told me otherwise, so I never registered — until the FTA came knocking."
Mr A had launched a services business and quickly landed a client based outside the UAE. Working from the common but incorrect assumption that exporting services placed him outside the VAT net entirely, he did not register with the Federal Tax Authority.
Under UAE VAT law, export of services is not the same as being exempt. It is treated as a taxable supply at the 0% rate, which means the business is still required to register for VAT and maintain full compliance, even though no VAT is actually charged on the invoice.
# Our Approach
– Clarified the law — explained that 0%-rated exports are taxable supplies, not VAT-exempt activities, and registration is mandatory once the threshold is met.
– Managed the registration — filed the overdue VAT registration through EmaraTax to bring the business into compliance without further delay.
– Built a compliance routine — put processes in place so future returns, invoicing, and record-keeping meet FTA requirements going forward.
The principle is simple: a 0% VAT rate is still a VAT rate, and registration obligations follow the transaction, not the location of the customer.
# The Result
Mr A registered for VAT, but because the registration was late, the FTA levied a late VAT registration penalty of AED 10,000. With registration now complete and proper compliance processes in place, his business is positioned to avoid further penalties and file correctly going forward.
# The Takeaway
"Zero-rated does not mean VAT-free. If you export services from the UAE, you still need to register — waiting until the FTA notices can cost you AED 10,000 in penalties."
